Agreement to these terms

These terms govern your use of estateprepinc.com and the informational content on it. By using this website, you agree to them. If you do not agree, please do not use the site.

We are not attorneys

Estate Prep Inc is a registered California legal document preparation company. We are not a law firm, and we are not attorneys.

• We cannot represent you in court.
• We cannot advise you about your legal rights or about the law.
• We cannot select legal forms for you.
• Using this website or contacting us does not create an attorney–client relationship, and our communications are not protected by attorney–client privilege.

What we can do is type or complete legal documents you have selected, at your specific direction; provide general published factual legal information written or approved by an attorney; provide published legal documents; and file and serve documents as you direct. If you need legal advice, please consult a licensed attorney.

Information on this site is general

Content on this website is general information about our services and about estate documents in California. It is not legal, tax, financial, or insurance advice, and it is not a substitute for professional advice about your situation. Laws change, and general information may not reflect your circumstances. Do not act or refrain from acting based on anything you read here without confirming it applies to you.

Your responsibilities as a client

Because we prepare documents at your direction rather than advising you, the accuracy of your documents depends on the accuracy of what you tell us.

• Provide complete, accurate, and current information.
• Select the documents and options you want prepared.
• Review every document carefully before signing.
• Tell us promptly if anything is wrong or has changed.
• Complete the steps that are yours to complete, such as retitling accounts and updating beneficiary designations.

We are not responsible for outcomes caused by information that was incomplete or inaccurate when you gave it to us.

Fees, payment, and cancellation

Fees are quoted as a flat fee and are set out in your signed contract. Prices shown on this website are current at the time of posting and may change; the fee in your signed contract is the fee that applies to you.

Your right to cancel, and any refund, are governed by your signed contract and by California law. You may cancel for any reason within 24 hours after both parties sign, and we must promptly refund fees except for services actually, necessarily, and reasonably performed during that period with your prior written consent. Additional cancellation rights apply if we fail to give you a copy of the contract, fail to specify services and costs, or fail to provide a required translation.

Third-party costs such as county recording fees, notary fees, and filing fees are set by others and are not refundable once incurred.

No guarantees

We make no guarantee or promise about results unless it is written in your signed contract and we have a factual basis for it. We cannot obtain special favors from, and have no special influence with, any court or any state or federal agency. Recording and filing timelines are controlled by county recorders and agencies, not by us.

Scheduling, forms, and electronic signatures

Booking an appointment through this website or a linked scheduling tool does not create a contract for services. A contract exists only when the required Notice to Consumer and the Legal Document Assistant contract are signed.

You agree that electronic signatures and electronically delivered documents have the same effect as handwritten signatures and paper documents, as permitted by California and federal law. You may request paper copies at any time.

Acceptable use

• Do not use this site for any unlawful purpose or to submit false information.
• Do not attempt to gain unauthorized access to any part of the site or its systems.
• Do not scrape, copy, or republish site content for commercial purposes without written permission.
• Do not submit another person's information without their permission.

Intellectual property

The design, text, graphics, and logos on this website are owned by Estate Prep Inc or used with permission, and are protected by copyright and trademark law. Documents we prepare for you are yours to use for your own purposes. Statutory and county forms remain public forms.

Third-party links and services

This site links to services we do not control, including scheduling, video, mapping, and payment providers. We are not responsible for their content, availability, or practices, and a link is not an endorsement.

Disclaimers and limitation of liability

This website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the site will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, Estate Prep Inc is not liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of this website. Nothing in these terms limits any liability that cannot be limited under California law, limits your rights under your signed contract, or affects the protection provided by our required bond.

Indemnification

You agree to indemnify and hold harmless Estate Prep Inc and its personnel from claims arising out of your misuse of this website, your violation of these terms, or information you submitted that was false or that you had no right to provide.

Governing law and venue

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. For any dispute arising from services provided under a signed Legal Document Assistant contract, venue is as stated in that contract — the California county of the client's primary residence. For disputes arising solely from use of this website, venue is a court of competent jurisdiction in California.

Consumer notices

You may obtain information from the local bar association, or from a legal aid or legal services office, about free or low-cost representation. You may contact the local police, sheriff, district attorney, or legal aid office if you believe you are the victim of fraud, the unauthorized practice of law, or other injury.

Changes to these terms

We may update these terms from time to time. The date at the top reflects the most recent revision, and continued use of the site after changes means you accept them. Changes to these website terms do not alter a contract you have already signed.
